Terms of Use

Gideon Solutions, LLC (“Gideon Tax,” “we,” “our,” or “us”) operates gideontax.com, its subdomains, the Gideon Tax tax professional portal and the Gideon Tax API (together, the “Service”). These Terms of Use are the agreement between you and us when you use the Service. By using the Service you agree to these terms. If you do not agree, do not use it.
What the Service does
Gideon Tax prepares and electronically files (“e-files”) federal tax returns and related forms with the Internal Revenue Service. We are an IRS Authorized e-file Provider: we file as the Electronic Return Originator (ERO) under our own EFIN and transmit through our own IRS-approved software. Some services, such as a change of address or an amended excise return, fill the official IRS form for you to file on paper instead; the page for each service says which it is before you pay.
We prepare your return from the information you give us, and we check it against the IRS’s published rules before it is filed. We are not a law firm and we do not give legal advice. Help text on the Service explains what the IRS form and its instructions ask for; it is not advice about your particular tax position. If you need that, talk to a tax professional you engage for it.
What you are responsible for
- The information on your return is your responsibility. You agree to give us true, complete and accurate information, and to review your return before you sign it. We file what you tell us; we cannot know facts you leave out.
- Your signature is real. When you sign an IRS e-file authorization on the Service (Form 8879 or one of its variants, such as Form 8879-EX), the PIN you choose or authorize is your signature on the return, under penalties of perjury. Sign only for yourself, or for a business or person you are authorized to sign for.
- The tax is yours to pay. Any tax, penalty or interest the IRS charges is owed by you to the IRS. Our fee does not include it, and we do not pay it on your behalf.
- Deadlines are yours to meet. Start early enough for the return to be filed, and corrected if the IRS rejects it, before its due date.
- Keep your account sign-in and any API keys secure. You are responsible for what is done with them.
Fees and refunds
The fee for each service is shown before you pay, and you are charged only when you submit the return. Payments are processed by our payment processor, Stripe; we do not store your card number.
- If we do not file a return you paid for, we refund the fee. That includes a return we decline to file and a return you ask us to cancel before it is sent to the IRS.
- If the IRS rejects a return we sent, we fix it with you and send it again at no extra charge. A rejection caused by information we need from you (for example, a new EIN the IRS has not yet recorded) is re-filed once you give it to us.
- Once the IRS has accepted a return, the fee has been earned and is not refunded. Correcting it is a new filing, such as an amended return, with its own fee.
- Tax professional plans and API partner credits are billed and refunded on the terms shown on the For pros and Partners pages.
What we cannot promise
We work to file every return correctly and on time, but the IRS decides whether to accept a return and how quickly it processes it. We do not guarantee that the IRS will accept a return, when it will send an acknowledgment, stamped Schedule 1 or refund, or the outcome of any IRS review. The IRS’s systems are sometimes unavailable, and a filing made during an outage is sent when they return.
Tax professionals and partners
If you use the tax professional portal to prepare returns for your clients, you must hold the credentials the IRS requires of you (a valid PTIN and, to e-file, an EFIN), follow IRS rules for preparers and EROs (including Publication 1345 and, where it applies to you, Circular 230), and have each client’s signed e-file authorization before a return is sent. Partners using the Gideon Tax API also agree to the terms on the Partners and API pages.
Acceptable use
You agree not to:
- file a return for anyone you are not authorized to act for, or file one you know to be false;
- use the Service for fraud, identity theft or any other unlawful purpose;
- try to get into accounts, data or systems that are not yours, or disrupt, overload, scrape or reverse-engineer the Service;
- use the Service in a way that breaks the IRS’s rules for e-file.
We may refuse a filing, suspend an account, or report activity to the IRS or law enforcement when we believe the Service is being misused, as the IRS requires of Authorized e-file Providers.
Your information
How we collect, use and protect your information, including tax return information under 26 U.S.C. § 7216, is described in our Privacy Policy and on our Security page. They are part of these terms.
Our content
The Service, its software, text and design belong to Gideon Solutions, LLC. You may use them to prepare and file your own returns, or your clients’ returns through the portal, and for no other purpose. IRS forms and publications are public and remain the IRS’s.
Limits on our liability
The Service is provided as it is and as available. To the extent the law allows, our total liability to you for any claim about a return is limited to the fees you paid us for that return, and we are not liable for indirect or consequential losses, such as lost profits. This does not limit a responsibility the law does not allow us to limit, including liability for our own fraud, gross negligence or willful misconduct.
If an error on a return is ours — a figure we calculated or transmitted differently from what you gave us — tell us. We will correct and re-file it at no charge, and we will work with you and the IRS on any penalty or interest that error caused.
Ending your use
You may stop using the Service at any time. We may suspend or close an account that breaks these terms. Returns already filed stay filed, and we keep records we are required by law to keep, as the Privacy Policy describes.
Governing law and disputes
These terms are governed by the laws of the State of North Carolina and applicable federal law. Please contact us first so we can try to resolve any problem directly. If we cannot, disputes will be heard in the state or federal courts located in Mecklenburg County, North Carolina, unless the law where you live gives you the right to bring them elsewhere.
Changes to these terms
We may update these terms. When we make material changes we will update the effective date at the top of this page and, where appropriate, give additional notice. A change does not apply to a return you had already paid for before it took effect.
